2.1. Orders can be placed through the online store as well as by email - sklep@mobilator.pl.
2.2. Order processing is possible only if the Customer operates an active business.
2.3.In case of any difficulties with completing the order form, it is possible to contact us by phone at the appropriate number indicated in the „CONTACT”.
2.4. Orders can be placed 24 hours a day, all year round. Orders placed on weekdays after 2:00 p.m., as well as on Saturdays, Sundays, and public holidays, will be processed on the next business day.
2.5. Incorrectly completed order forms will not be processed.
2.6. New Portable Devices reserves the right to refuse order fulfillment.
2.7. The prices of the products listed in the store are expressed in Polish zlotys (and optionally in foreign currencies) and are provided both net and gross (including VAT).
2.8. The ordered goods should be delivered to the pickup point address indicated by the Customer — within the delivery time specified on the portal for the given product, counted from the moment the order is confirmed and fully paid.
2.9. If an item is out of stock, the Customer will be informed about this fact, along with the resulting extension of the order processing time and any possible change in product price.
2.10. If the product is unavailable in stock and the Customer has selected the “Cash on delivery” payment option, New Portable Devices has the right to renegotiate the delivery and payment method or to withdraw from fulfilling the order.
2.11. A purchase confirmation (VAT invoice) is attached to each shipment. If the Customer is a VAT payer (e.g., a business entity), we kindly request sending an authorization to issue a VAT invoice without the recipient’s signature to the email: sklep@mobilator.pl provided in the „CONTACT” section. The authorization form can be downloaded here.
2.12. The Customer shall settle the payment for the ordered goods via bank transfer (prepayment).
3.1. Product delivery is available worldwide.
3.2. Delivery of the Product to the Customer is subject to a fee unless the Sales Agreement states otherwise. Delivery costs (including transport, shipping, and postal service fees) are presented to the Customer during the order placement process, including at the moment the Customer expresses the will to enter into the Sales Agreement.
3.3. Personal pickup of the Product by the Customer is free of charge.
3.4. The Seller provides the following methods of delivery or pickup:
3.4.1. Postal shipment, standard or cash on delivery (cash on delivery available only within Poland).
3.4.2. Courier shipment, standard or cash on delivery (cash on delivery available only within Poland).
3.4.3. Free personal pickup available at: Drogowców 14, 39-200 Dębica — Monday to Friday, between 08:00 and 16:00 (excluding public holidays).
3.5. The delivery time of the Product to the Customer is up to 30 calendar days, unless a shorter period is specified in the description of a given Product or during the ordering process. In the case of Products with different delivery times, the applicable delivery time is the longest indicated period, which however may not exceed 30 calendar days (for larger quantity orders the delivery time is arranged individually) – an exception exists in the case of a custom-made purchase, as referred to in item 3.7. The start of the delivery period to the Customer is calculated as follows:
3.5.1. In the case of the Customer choosing payment by bank transfer – from the date the Seller’s bank account or settlement account is credited.
3.5.2. In the case of the Customer choosing cash on delivery – from the date the Sales Agreement is concluded (cash on delivery may be used only for products currently available in stock).
3.5.3. In the case of the Customer choosing payment in the installment system – from the date the Seller is notified by the lender of the conclusion of a credit agreement with the Customer, but no later than from the date the Seller’s bank account is credited with the funds from the credit granted to the Customer (this point applies only to periods when installment payment methods are offered on our portal).
3.6. The product readiness time for pickup by the Customer – in the case of the Customer choosing personal pickup, the Product will be ready for pickup within up to 30 calendar days, unless a shorter period is specified in the description of a given Product or during the ordering process. In the case of Products with different readiness times, the applicable readiness time is the longest indicated period, which however may not exceed 30 calendar days – an exception exists in the case of a custom-made purchase, as referred to in item 3.7. The Customer will be additionally informed about the Product’s readiness for pickup via an email sent by the Seller to the email address provided during the ordering process. The start of the readiness period is calculated as follows:
3.6.1. In the case of the Customer choosing payment by bank transfer, electronic payments or payment card – from the date on which the Seller’s bank account or settlement account is credited.
3.6.2. In the case of the Customer choosing cash payment upon personal pickup – from the date the Sales Agreement is concluded.
3.6.3. In the case of the Customer choosing payment in the installment system – from the date the Seller is notified by the lender of the conclusion of a credit agreement with the Customer, but no later than from the date on which the Seller’s bank account is credited with the funds from the credit granted to the Customer.
3.7. The delivery time of the product to the Customer may exceed 30 days if:
3.7.1. The parties have mutually agreed to a longer period.
3.7.2. The product, due to its specificity, is manufactured or prepared to order.
4.1. in cash at the cash desk upon pickup of the goods at the New Portable Devices sales office (Drogowców 14, 39-200 Dębica),
4.2. by bank transfer (based on the Proforma Invoice previously issued by New Portable Devices).
4.3. through the PayU payment system,
4.4. through the PayPal system.

On the transfer order (or postal payment form), please provide the order number (this number is given in the email confirming the order) and add the note “Online order”. The order will be processed once the payment appears in the New Portable Devices account.
6.1. The basis and scope of the Seller’s liability towards the Customer, if the sold Product has a physical or legal defect (warranty for defects), are defined by generally applicable laws, in particular the Civil Code.
6.2. The Seller is obliged to deliver a Product free of defects to the Customer. Detailed information regarding the Seller’s liability for Product defects and the Customer’s rights is provided on the Online Store’s website, in the “Product complaint” section.
6.3. A complaint may be submitted by the Customer in the following ways:
6.3.1. in writing to the address: Drogowców 14, 39-200 Dębica;
6.3.2. electronically via email to the address: sklep@mobilator.pl;
6.3.3. each complaint/service request must include a completed RMA file. The file can be downloaded here.
6.4. It is recommended that the Customer includes in the complaint description: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of the defect occurrence; (2) the Customer’s decision on the method of bringing the Product into conformity with the Sales Agreement or a statement on price reduction; and (3) the contact details of the person submitting the complaint – this will facilitate and speed up the complaint handling process by the Seller. The requirements listed in the previous sentence are only recommendations and do not affect the validity of complaints submitted without the recommended description.
6.5. The Seller will respond to the Customer’s complaint immediately, no later than within 14 calendar days from the date of its submission. Failure by the Seller to respond within the above deadline means that the Seller has considered the complaint justified.
6.6. If, for the Seller to respond to the Customer’s complaint or to perform the Customer’s rights resulting from the warranty for defects, it is necessary to deliver the Product to the Seller, the Customer will be asked to deliver the Product at their own cost to the address Drogowców 14, 39-200 Dębica. However, if due to the type of defect, the type of Product, or the manner of its installation, delivery of the Product by the Customer would be impossible or excessively difficult, the Customer will be asked to provide access to the Product, after agreeing on the date in advance, at the place where the Product is located (however, in such a case the Seller will arrange the cost of travel to the Customer’s premises with the Customer).
7.1. A Consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring any costs, except for the costs specified in item 7.8 of the Terms and Conditions. To meet the deadline, it is sufficient to send a statement before its expiry.
In the case of the assortment presented on www.mobilator.pl, the Consumer must take into account that these are industrial devices. Most devices come in a very large number of versions, which means that the production process is initiated by the manufacturer based on an order placed by New Portable Devices. This means that the industrial devices offered on www.mobilator.pl are made to special order and are not subject to the 14-day withdrawal rules.
In exceptional cases (products that are not manufactured to order), the statement of withdrawal from the contract may be submitted, for example:
7.1.1. in writing to the address: Drogowców 14, 39-200 Dębica;
7.1.2. electronically via email to the address: sklep@mobilator.pl;
7.2. A model withdrawal form is included in Annex No. 2 to the Consumer Rights Act and is additionally available on the Online Store website in the “Withdrawal information” section. The Consumer may use the template form, but it is not mandatory.
7.3. The withdrawal period begins:
7.3.1. for a contract under which the Seller delivers a Product and is obliged to transfer ownership of it (e.g. a Sales Agreement) – from the moment the Consumer or a third party indicated by the Consumer, other than the carrier, takes possession of the Product; and in the case of a contract that: (1) covers multiple Products delivered separately, in batches or in parts – from taking possession of the last Product, batch or part; or (2) involves the regular delivery of Products for a specified period – from taking possession of the first Product;
7.3.2. for other contracts – from the date of conclusion of the contract.
7.4. In the event of withdrawal from a distance contract, the contract is considered void.
7.5. The Seller is obliged to immediately, no later than within 14 calendar days from the date of receiving the Consumer’s statement of withdrawal, refund all payments made by the Consumer, including the cost of delivery of the Product (except for additional costs resulting from the Consumer’s choice of a delivery method other than the least expensive standard method available in the Online Store). The Seller refunds the payment using the same payment method used by the Consumer, unless the Consumer explicitly agrees to another method that does not incur any costs for them. If the Seller has not offered to collect the Product themselves, they may withhold the refund until receiving the returned Product or until the Consumer provides proof of its return shipment, whichever occurs first.
7.6. The Consumer is obliged to immediately, no later than within 14 calendar days from the date of withdrawal from the contract, return the Product to the Seller or hand it over to a person authorized by the Seller to collect it, unless the Seller has offered to collect the Product themselves. To meet the deadline, it is sufficient to send back the Product before the deadline expires. The Consumer may return the Product to the address: Drogowców 14, 39-200 Dębica.
7.7. The Consumer is liable for any reduction in the value of the Product resulting from handling it beyond what is necessary to determine the nature, characteristics, and functioning of the Product.
7.8. Possible costs related to the Consumer’s withdrawal from the contract that the Consumer is obliged to bear:
7.8.1. If the Consumer has chosen a method of Product delivery other than the least expensive standard delivery method available in the Online Store, the Seller is not obliged to refund the additional costs incurred by the Consumer.
7.8.2. The Consumer bears the direct cost of returning the Product.
7.8.3. In the case of a Product being a service, the performance of which – at the explicit request of the Consumer – began before the expiry of the withdrawal period, the Consumer who exercises the right of withdrawal after making such a request is obliged to pay for the services performed until the moment of withdrawal. The payment amount is calculated proportionally to the extent of the performed service, taking into account the agreed price or remuneration. If the price or remuneration is excessive, the basis for calculation is the market value of the performed service.
7.9 The Consumer is not entitled to withdraw from the contract in relation to contracts:
7.9.1.(1) for the provision of services, if the Seller has fully performed the service with the Consumer’s explicit consent, who was informed before the performance began that after the service is completed by the Seller they will lose the right to withdraw from the contract; (2) in which the price or remuneration depends on financial market fluctuations beyond the Seller’s control and which may occur before the withdrawal deadline; (3) in which the subject of the performance is a non-prefabricated Product manufactured according to the Consumer’s specification or serving to meet their individual needs; (4) in which the subject of the performance is a Product that deteriorates quickly or has a short shelf life; (5) in which the subject of the performance is a Product delivered in sealed packaging which, once opened, cannot be returned for health or hygiene reasons, if the packaging was opened after delivery; (6) in which the subject of the performance are Products that, after delivery, due to their nature, become inseparably connected with other items; (7) in which the subject of the performance are alcoholic beverages, whose price was agreed upon at the conclusion of the Sales Agreement, and delivery can take place only after 30 days and whose value depends on market fluctuations beyond the Seller’s control; (8) in which the Consumer explicitly requested the Seller to visit them for urgent repair or maintenance; if the Seller additionally provides other services than those requested by the Consumer, or delivers Products other than spare parts necessary for repair or maintenance, the right of withdrawal applies to those additional services or Products; (9) in which the subject of the performance are audio or video recordings or computer software delivered in sealed packaging, if the packaging was opened after delivery; (10) for the supply of newspapers, periodicals or magazines, except for subscription contracts; (11) concluded through a public auction; (12) for the provision of accommodation services, other than for residential purposes, transportation of goods, car rental, catering, or services related to leisure, entertainment, sports or cultural events, if the contract specifies the date or period of providing the service; (13) for the supply of digital content not supplied on a tangible medium, if performance began with the Consumer’s explicit consent before the withdrawal deadline and after the Consumer was informed of the loss of the right of withdrawal.
If the Customer agrees upon and confirms (via email) with an New Portable Devices employee an order regarding the technical specification and quantity of devices, and makes payment for the order – the Customer does not have the right to cancel such an order without cost. It is possible to cancel such a confirmed order only within 3 business days from the moment the payment is credited to the New Portable Devices account, with a simultaneous deduction of 10% of the order value by New Portable Devices.
(The above restriction is caused by the realities of the production and distribution system of industrial devices handled by New Portable Devices.)
New Portable Devices reserves the right to refuse order fulfillment in the event of errors occurring on the store’s website, consisting in the display of incorrect information regarding prices or product availability.

The company New Portable Devices undertakes to protect personal data in accordance with the Act on the Protection of Personal Data. In accordance with this Act, Store Customers have the right to access their data, correct it, and submit a request to cease its processing. Personal data provided during purchases is processed solely for the purpose of fulfilling the placed order.
In matters not regulated by these Terms and Conditions, the provisions of the Polish Civil Code and relevant acts shall apply.
The court competent to resolve disputes shall be the court having jurisdiction over the Seller’s registered office.
The Ordering Party should familiarize themselves with the terms specified in these Terms and Conditions before placing an order. Placing an order shall be deemed acceptance of the above terms.
10.1. The Service does not automatically collect any information, except for information contained in cookies.
10.2. Cookies (so-called “cookies”) are IT data, in particular text files, which are stored on the end device of the Service User and are intended for use with the Service’s websites. Cookies usually contain the name of the website from which they originate, the time they are stored on the end device, and a unique number.
10.3. The entity placing cookies on the end device of the Service User and obtaining access to them is New Portable Devices, with its registered office in Dębica at Drogowców 14. Cookies are used for the purpose of:
a) adjusting the content of the Service’s websites to the User’s preferences and optimizing the use of websites; in particular, these files allow recognition of the Service User’s device and appropriate display of the website, tailored to their individual needs;
b) creating statistics that help understand how Service Users use the websites, which enables improvement of their structure and content;
c) maintaining the Service User’s session (after logging in), thanks to which the User does not have to re-enter their login and password on each subpage of the Service;
d) personalization of marketing messages;
e) ensuring the security and reliability of the Service.
10.4. Within the Service, two main types of cookies are used: “session cookies” and “persistent cookies”. “Session cookies” are temporary files that are stored on the User’s end device until logging out, leaving the website, or closing the software (web browser). “Persistent cookies” are stored on the User’s end device for the time specified in the cookie parameters or until they are deleted by the User.
10.5. Within the Service, the following types of cookies are used:
a) “necessary” cookies, enabling the use of services available within the Service, e.g. they may remember previous actions (e.g. opened texts) when returning to a page within the same session;
b) authentication cookies used for services requiring authentication within the Service;
c) cookies used to ensure security, e.g. used to detect abuse in the area of authentication within the Service;
d) “performance” cookies, enabling the collection of information on how the Service’s websites are used;
e) “functional” cookies, enabling the “remembering” of settings selected by the User and personalization of the User interface, e.g. in terms of selected language or region of origin, font size, website appearance, etc.;
f) “advertising” cookies, enabling the delivery of advertising content to Users more tailored to their interests.
10.6. In many cases, web browsing software (a web browser) allows cookies to be stored on the User’s end device by default. Service Users may change cookie settings at any time. These settings may be changed in particular to block automatic handling of cookies in the web browser settings or to inform about each instance of cookies being placed on the Service User’s device. Detailed information about the possibilities and methods of handling cookies is available in the software (web browser) settings.
10.7. The Service Operator informs that restrictions on the use of cookies may affect some functionalities available on the Service’s websites.
10.8. Cookies placed on the Service User’s end device may also be used by advertisers and partners cooperating with the Service Operator, such as Facebook, Google, and Twitter.
